1. Acceptance of Terms

By accessing and using Malabas ("the App"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Eligibility

You must be at least 16 years old to use Malabas. By using the App, you represent and warrant that you are at least 16 years of age and have the legal capacity to enter into this agreement.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify Malabas immediately of any unauthorized use of your account. Malabas reserves the right to suspend or terminate accounts that violate these terms.

4. Prohibited Conduct

You agree not to:

• Post false, misleading, or fraudulent listings
• Sell prohibited items (weapons, drugs, counterfeit goods, etc.)
• Harass, abuse, or harm other users
• Violate any applicable laws or regulations
• Use the App for any illegal or unauthorized purpose
• Interfere with or disrupt the App's functionality

5. Listings and Transactions

Sellers are responsible for accurately describing their items. Buyers are responsible for reviewing item details before purchasing. All transactions are between buyers and sellers; Malabas facilitates the transaction but is not a party to the sale.

6. Payments and Fees

Malabas charges a 5% platform fee on all transactions. Payments are processed through PayPal. Sellers must provide a valid PayPal email to receive payouts. Refunds are subject to the refund policy and may be processed at the seller's discretion or in cases of non-delivery.

7. Shipping and Delivery

Sellers are responsible for shipping items as described. Buyers are responsible for providing accurate shipping addresses. Malabas is not responsible for lost, damaged, or delayed shipments.

8. Intellectual Property

All content on Malabas, including text, graphics, logos, and software, is the property of Malabas or its content suppliers. You may not reproduce, distribute, or create derivative works without written permission from Malabas.

9. Privacy

Your use of the App is also governed by the Privacy Policy. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.

10. Dispute Resolution

If you have a dispute with another user, contact them directly. Malabas may assist in resolving disputes but is not obligated to do so. For payment disputes, PayPal's dispute resolution process applies.

11. Limitation of Liability

Malabas is provided "as is" without warranties of any kind. Malabas is not liable for any indirect, incidental, or consequential damages arising from your use of the App.

12. Modifications to Terms

Malabas reserves the right to modify these terms at any time. Continued use of the App after changes constitutes acceptance of the new terms. Users will be notified of significant changes.

13. Termination

Malabas may terminate or suspend your account immediately, without prior notice, for conduct that violates these Terms or is harmful to other users or third parties.
